1. Agreement to Terms

By accessing or using AutoTextBack's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

These Terms constitute a legally binding agreement between you and AutoTextBack regarding your use of our missed-call text-back service.

2. Description of Service

AutoTextBack provides an automated missed-call text-back service that sends SMS messages to callers when you are unable to answer the phone. Our service includes:

• Automated SMS responses to missed calls
• A dedicated local phone number
• Call forwarding setup
• Spam call filtering
• Missed call analytics

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be a resident of Canada or have a Canadian business
• Have the legal authority to enter into this agreement
• Use the service for legitimate business purposes

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Fees and Payment

Monthly Fee: A recurring fee of $99 CAD per month for unlimited text messages. There is no setup fee.

Billing: Monthly fees are billed in advance. Payment is processed through Stripe using the payment method you provide.

Number Porting: If you wish to port your number to another provider, a one-time fee of $30 CAD applies.

6. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time. There are no long-term contracts or cancellation penalties. Your service will continue until the end of your current billing period.

Refund Process: Refunds will be processed to your original payment method within 5-10 business days.

7. Acceptable Use

You agree not to use our service to:

• Send spam, unsolicited messages, or bulk commercial messages
• Harass, threaten, or harm others
• Transmit illegal, harmful, or offensive content
• Violate Canada's Anti-Spam Legislation (CASL) or any other applicable laws
• Impersonate any person or entity
• Interfere with or disrupt our service or servers
• Attempt to gain unauthorized access to our systems

We reserve the right to suspend or terminate your account for violations of these terms.

8. CASL Compliance

You are responsible for ensuring that your use of our service complies with Canada's Anti-Spam Legislation (CASL). Our service is designed for transactional messages in response to customer inquiries. You must not use our service to send unsolicited commercial electronic messages.

9. Intellectual Property

AutoTextBack and its associated logos, designs, and content are the intellectual property of AutoTextBack. You may not use our trademarks or copyrighted materials without prior written consent.

10. Disclaimer of Warranties

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our service will be uninterrupted, error-free, or completely secure.

We make no guarantees regarding the delivery of SMS messages, as delivery depends on third-party carriers and network conditions.

11. Limitation of Liability

To the maximum extent permitted by law, AutoTextBack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless AutoTextBack, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our service or violation of these Terms.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of our service after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of our service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Ontario, Canada.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
